While politically there was no end to the impasse that first developed on September 8, when the chief minister announced in the Maharashtra legislature that he had handed in his resignation to Congress party leader Indira Gandhi, indications were that things were finally coming to a head.<br><br>Although no official announcement on the fate of his resignation letter was made by the party High Command, the press took Mrs Gandhi's departure for the North-South dialogue at Cancun as a cue to announce that the resignation had been turned down. Chief Minister Abdul Rehman Antulay lent weight to these reports on October 18, when he sacked Baburao Kale, the state rural development and jails minister.<br><br><b><div class="itg-mosimage"><amp-img src="https://ancillary-proxy.atarimworker.dev?url=https%3A%2F%2Fakm-img-a-in.tosshub.com%2Fsites%2Fmedia2%2Findiatoday%2Fimages%2Fstories%2F1981November%2Fnew-suits-1_102613091132.jpg" alt="" height="425" width="650" class="" layout="responsive"></amp-img>Antulay: Image building</div>Heightened Speculation</b>: But Kale's departure only served to heighten the already wild speculation that has been circulating ever since the sensational disclosures rocked Parliament and the nation in September. While the press and the public continued to make inspired guesses about his eventual fate, Antulay himself has spent the past month in a hectic image-building campaign that included a tour of many rural areas and towns in the state.<br><br>Drawing large crowds at the stage-managed public meetings, Antulay used the opportunity to lash out at both the press and judiciary, berating these institutions for being biased against him and being controlled by vested interests. His repeated shows of strength, combined with Mrs Gandhi's frigid silence on the subject of his resignation, served to confuse his critics and detractors.<br><br>Said Prabhakar Kunte, a follower of Kale who has been a constant critic of the chief minister: '"It is amazing that a chief minister who has voluntarily tendered his resignation should go around parading in the state like a chief minister at the height of his power. He is virtually challenging the High Command to take action against him. He thinks he is invincible."<br><br><b>Another Challenge</b>: But Antulay's "invincibility" was challenged on another more dramatic front last fortnight. Possibly, because all other methods have resulted in a stalemate, opposition groups in Bombay took increasingly to the law courts in their campaign against him. By the end of the month, in fact, the string of lawsuits filed against him had grown to include three Bombay High Court writ petitions, a writ petition in the Supreme Court, and a criminal complaint on grounds of cheating, extortion and graft filed by Bharatiya Janata Party, (BJP) worker Ramdas Nayak.<br><br>Mrinal Gore, long a champion of popular citizens' causes in Bombay started the fusillade with a writ petition asking that the High Court restrain the Maharashtra Government from distributing cement in any manner except that prescribed by law. Along with P.B. Savant and Jagannath Jadhav, her co-petitioners. Gore claimed that she had been deprived of a small amount of cement which she needed for urgent monsoon repairs because the chief minister had subverted the distribution process of this essential commodity.<br><br>Quoting from a Maharathra Government resolution of 1978 and the Cement Control Order, 1973, her counsel argued that there was a legally established procedure for cement distribution which Antulay's Government had bypassed and ignored with a view to favour certain builders in return for illegal gratification. With further hearings scheduled later this month, the judge passed interim orders restraining the state civil supplies machinery from using any arbitrary or adhoc method of allotment till the case is finally decided.<br><br><b><div class="itg-mosimage"><amp-img src="https://ancillary-proxy.atarimworker.dev?url=https%3A%2F%2Fakm-img-a-in.tosshub.com%2Fsites%2Fmedia2%2Findiatoday%2Fimages%2Fstories%2F1981November%2Fnew-suits-2_102613091217.jpg" alt="" height="425" width="650" class="" layout="responsive"></amp-img>Dandavate: Taking up cudgels</div>Basic Issues</b>: Another group of petitioners, meanwhile, moved the Supreme Court on the more basic question of Fundamental Rights. Claiming that they had not been given small quantities of cement for repair work while builders who were lower on the scale of priority received huge amounts of the scarce commodity they argued that their right to equality as guaranteed by Article 14 of the Constitution had been violated.<br><br>Yet another petition filed by veteran trade unionist R.J. Mehta in Bombay questions the role of two sitting judges of the Bombay High Court who are trustees of the Indira Gandhi Pratibha Pratishthan. Indira Jaisingh, Mehta's counsel has appealed to the Court to bar Justices Masodkar and Aggarwal, both trustees of Antulay's controversial charity, from hearing any cases on the grounds that they have forfeited their claim to impartiality by associating themselves with a trust which was so political in its nature.<br><br>Far more dramatic and hard-hitting is the petition filed by the former railway minister Madhu Dandavate of the Janata Party. In a sweeping petition which goes into most of the misdeeds which Antulay is being accused of, Dandavate has contended that two of the chief minister's trusts, the Indira Gandhi Pratibha Pratishthan and the Konkan Unnati Mitra Mandal, are illegally registered, improperly formed, have got tax benefits they are not entitled to, and have collected funds from the exchequer and public through dubious means and fraud.<br><br>His brief adds that both the Maharashtra legislature and public were deceived by the-chief minister about the nature of the trusts, and that he used his official position and the state machinery to fill their overflowing coffers. Demanding that the court should order an independent enquiry into these trusts and their affairs, Dandavate's petition goes on to say that all funds which have been collected by deception and fraud should be returned to the donors.<br><br>Convinced that the matter was serious enough to warrant it, Justice S.C. Pratap passed an interim order freezing the funds collected by both trusts and restraining the trustees from appropriating, using or transferring more than Rs 5,000 per trust till the case is heard and decided.</p><p><b><div class="itg-mosimage"><amp-img src="https://ancillary-proxy.atarimworker.dev?url=https%3A%2F%2Fakm-img-a-in.tosshub.com%2Fsites%2Fmedia2%2Findiatoday%2Fimages%2Fstories%2F1981November%2Fnew-suits-3_102613091248.jpg" alt="" height="425" width="650" class="" layout="responsive"></amp-img>Kunte and Kale: In revolt</div>Criminal Complaint</b>: But perhaps the greatest threat to Antulay comes from the criminal complaint filed by Ramdas Nayak. While the other suits are writ petitions aimed at maintaining the status quo or preventing further excesses, Nayak has accused the chief minister of cheating, accepting illegal gratification in the course of his official duties corruption and extortion.<br><br>Among the cases mentioned was one in which Mahesh Dadlani and his associates received a no-objection certificate from the Government to lease a property - on Mahatma Gandhi Road to the Indq-Suez Bank. At around the same time Dadlani made a contribution of Rs 8 lakh to the Indira Gandhi Pratibha Pratishthan. <br><br>Squarely indicting the chief minister, criminal lawyer Ram Jethmalani quoted from a legislative assembly abstract of April 22, 1981, in which Antulay himself states on the floor of the House that "he had received Rs 8 lakh and issued the 'no-objection certificate and that he would continue to issue such certificates in future."</p><p>While Additional Chief Metropolitan Magistrate S. P. Ghogare ruled after the preliminary hearings that Antulay could be prosecuted for cheating and extortion (Sections 420 and 384 IPC) he refused to admit the charges of corruption and accepting illegal gratification as cases of this nature which involve a public servant require the previous sanction of the governor. <br><br>Undeterred by this ruling, Nayak promptly moved the High Court in an appeal based on constitutional interpretation, hoping that he would get permission to go the whole hog and prosecute the chief minister on all possible counts. Said Nayak: "If we have to get the governor's sanction for cases of corruption against the chief minister it is almost like saying that we cannot prosecute him.The governor has to accept the chief minister's advice, and it is obvious that he will not advise, his own prosecution.
