Two observations made by the Supreme Court have sparked a huge debate. Both the observations were made by the Chief Justice of India SA Bobde.
In a shocking case where a minor was sexually assaulted for years by a man who is a government employee, the Supreme Court bench headed by the Chief Justice of India SA Bobde granted protection from arrest to the accused for four weeks.
The Chief Justice of India SA Bobde further asked the 23-year-old govt servant whether he was ready to marry the woman who has accused him of rape.
While in the second case, a woman has alleged that she was raped by her partner. And hearing the case, CJI Bobde asked, "If a couple is living together as man and wife, the husband may be a brutal man, but can you call the act of sexual intercourse a rape?"
